XI 3.0: The problem only occurs when you attempt to assign a Business System to your scenario under "Service without Party" and found it will not work because the business system is assigned to another scenario under "Service without party". There is a solution.
It can be done. It is not a problem, and once you understand how it works it makes sense.
Just go to the "Objects" tab
Find the business system under "Service without Party"
Right click the business system and choose "Add to Scenario"
Specify your scenario.
Now the Business system is assigned to your scenario as well.
The system simply stops us from creating the object twice.
Object uniqueness is more clearly understood on the "Objects" tab. The "Scenarios" tab is there to group our related bits of config together so we can find it more easily, but the scenario does not define uniqueness of an object.
This makes sense for "Party" as well. You can create a Party and assign it to more than one Scenario, and on a customer site this would probably happen often because a Party represents a Partner and that Partner might have multiple EDI scenarios.
