Bar Chart issue: data overlap with with bar with depth

Hello,

I found the following problem about bar chart in CR2008 but not CR7.

1. Add a bar chart to the report.

2. Right click chart option

3. In general tab, tick use depth

4. In Data labels tab, tick show data labels and select outside maximum

In the report preview, the data will overlap with the bar. Is it a bug in CR2008?
