We need to perform system refresh of quality system using production data. Both are ABAP+JAVA , but Quality system is having higher sp version than the production system.
Could you please let me know, How should i go to perform the system refresh.
1. Using backup / restore , Only PRD online backup is possible from our side, Can we refreh ABAP+JAVA using online backup?
2. Using sapinst: It is not possible to perform system copy using sapinst, as we have not been given any downtime for PRD to perform export.
Requesting you to share your views , If you encountered this kind of scenario.

Take central instance export. Can do without downtime .. Then use online backup + redolog to restore the database.
Follow system copy guide.
But lots of configuration changes need to be done to make Java up

An homogeneous system copy is what you need to do. Specially the Java system could give you a lot of trouble if its done any other way.

I would like to know if a system copy using sapinst export/ import can be done for ABAP+JAVA Netweaver system when the source and the traget are at different SP stack levels ?
I have not seen anything in the guide that particularly mentions the SP levels ?
Also, my target system is at a newer Kernel patch level ?

You may want to check homogenous system copy.

In your case the system copy is not possible. To perform it you should have your systems at same SP level.
By the way, you can use backup/restore method.
